RTI Act 2005: What Every Postal Employee Must Know – A Practical Guide for Department of Posts Staff

 


The Right to Information (RTI) Act, 2005 is one of the most important transparency laws in India. For us in the Department of Posts, RTI is not just a legal formality—it is part of our duty as public servants.

From Branch Post Offices to Divisional Offices, every postal employee plays a role in ensuring transparency, accountability, and timely service. This article explains the RTI Act from the postal department’s point of view, so that every GDS, Postal Assistant, Inspector, Superintendent, and Head of Office understands their responsibility clearly.




1️⃣ What Does “Information” Mean for Postal Staff?

Under Section 2(f) of the Right to Information Act, 2005, “information” includes any material available in records. In the postal context, this may include:

  • Service books and appointment orders

  • Transfer/posting orders

  • Recruitment records (GDS, PA, MTS, etc.)

  • PLI/RPLI policy details and registers

  • Savings Bank records (as per rules)

  • Tender documents and contracts

  • Inspection reports

  • Log books, stock registers, and financial statements

  • Emails and official correspondence

Important for CPIOs and Staff:

You are required to provide only existing records.
You are not required to:

  • Create new information

  • Give personal opinions

  • Explain “why” a decision was taken

  • Answer hypothetical questions

If it is not available in official records, it cannot be created for RTI.


2️⃣ Record Maintenance: A Direct Responsibility of Postal Offices

Section 4 of the RTI Act emphasizes proper record management.

For postal offices, this means:

  • Maintaining files properly catalogued and indexed

  • Preserving SB, PLI, GDS, and establishment records as per retention schedule

  • Digitizing data wherever possible

  • Ensuring transparency in recruitment and financial matters

Suo Motu Disclosure – Reduce RTIs

If divisions and circles proactively publish information such as:

  • Recruitment notifications

  • GDS merit lists

  • Transfer guidelines

  • Tender notices

  • Citizen charters

on official websites, many RTI applications can be avoided.

Transparency reduces workload.


3️⃣ Role of Post Offices in RTI Process

In the RTI system, postal officials may function as:

  • CPIO (Central Public Information Officer)

  • CAPIO (Central Assistant Public Information Officer)

  • Appellate Authority

CAPIO Role (Important for Many Postal Units)

A CAPIO’s job is similar to postal transmission:

  • Receive RTI applications or appeals

  • Forward them to the concerned CPIO or authority

Timely forwarding is critical because delay affects the statutory timeline.


4️⃣ Timelines – Strict Compliance Required

RTI is time-bound. Delays can lead to penalties.

For Divisional and Circle Offices, monitoring RTI pendency is essential.
Delay due to file movement or negligence is not accepted as a valid excuse.


5️⃣ When Can Information Be Denied?

Transparency is the rule, but Section 8 provides exemptions.

Postal authorities may deny information in cases such as:

  • Matters affecting national security

  • Information restricted by court orders

  • Personal information unrelated to public interest

  • Commercial confidence or tender secrecy (before finalization)

However, denial must:

  • Be properly reasoned

  • Quote the correct section of the RTI Act

  • Be communicated in writing

Unjustified denial can attract penalty.


6️⃣ Penalty Provisions – Serious Consequences

Under Section 20 of the RTI Act:

  • ₹250 per day penalty

  • Maximum ₹25,000

  • Possible recommendation for disciplinary action

If a CPIO:

  • Refuses without reasonable cause

  • Delays without justification

  • Provides misleading or incorrect information

The Information Commission can impose penalty.

For postal officers, this may also affect service records and career progression.


7️⃣ What Postal Employees Should Remember

✔ Maintain proper records
✔ Reply within timeline
✔ Provide only recorded information
✔ Avoid personal interpretation
✔ Follow proper exemption rules
✔ Maintain transparency in recruitment and financial matters

For GDS and branch offices, ensure records are updated and accessible to higher authorities when RTI queries arise.
